Workout Apps Subscription Terms and Conditions
Introduction: These terms and conditions govern your subscription to the services provided by GoodFitness App (āweā, āourā, or āusā). By subscribing, you accept and agree to be bound by these terms.
Subscription Details: As a subscriber, youāll receive access to the individual purchase of [,program workouts, personalized training meal plans, etc.].
Billing & Payment: Your chosen subscription fee will be billed directly to your chosen form of payment to your account. Ensure sufficient funds are available to avoid service interruptions. You can update your payment method in the settings section of the app.
Trial Period: We donāt offer any 1 day free trial periods for customized meal plans. Day 1 of all training programs are unlocked for free to try without purchase of the program. The app is a free download, you will not be billed until you complete the purchase of the desired program.
5 Month Free Access: You will receive a 5 month free access to the first program purchased on Goodfitness App. If you to later purchase an additional program the 5 month free access will not apply, it only applies one time to the initial purchase. You will not be charged monthly for each individual program. The monthly Goodfitness App charge will maintain access to all programs purchased under your account.
Auto-Renewal & Cancellation: Unless you cancel, your subscription renews automatically. Manage or end your subscription in your account settings of the Goodfitness App.
Refunds: We donāt process refunds for subscriptions. If you cancel your subscription before the next billing cycle you will not be charged the next month.
Price Modifications: We may adjust subscription prices occasionally. Weāll inform you beforehand, giving you the chance to modify or cancel your subscription.
Service Termination: We retain the right to terminate or pause your subscription if you violate these terms.

These Terms of Service (āTermsā) are a legal agreement between you and Goodfitness App (āHome workout apps,ā āus,ā or āweā) regarding your use of services available at or through any iOS/Android application made by Goodfitness App and available for download through a third party applications store, including any downloadable software program that you are accessing or installing on your device or personal computer and the services available through that software program (together, the āService(s)ā).
BY USING ANY PORTION OF THE SERVICE, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

Our Service provides educational tools for fitness, health, and wellbeing, encompassing postpartum wellness, high-intensity interval workouts, conventional strength training, meditation, and more.
The Service is an education tool designed to help with various forms of fitness, health and wellbeing, including but not limited to the practice of postpartum wellness, high intensity interval training, conventional strength training, meditation, and breath work.
Usage Criteria
To access our Platform, individuals must be at least 18 years old. Itās essential that user profile data is correct and updated. Our services arenāt designed for anyone younger than 18 and are not available where theyāre legally restricted.
To use our Service, you must be at least 18 years old. Ensure your profile details are accurate. The Service isnāt for those under 18 and is void where banned.
You must be 18 years of age or older to use the Service. You represent and warrant that any profile information you submit is true and accurate and that you are 18 years of age or older and are fully able and competent to enter into, and abide by these Terms. Goodfitness App reserves the right to modify or discontinue, temporarily or permanently, all or a part of the Service without notice. Goodfitness App will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
No Support
Unless otherwise agreed by Goodfitness App in writing, Goodfitness App is not obligated to provide any support for the Service.

Feedback
If you provide feedback to GoodFitness App regarding the Service (āFeedbackā), you acknowledge that the Feedback is not confidential and you authorize Goodfitness App to use that Feedback without restriction and without payment to you. Accordingly, you hereby grant to Goodfitness App as a nonexclusive, royalty-free, fully-paid, perpetual, irrevocable, transferable, and fully sublicensable right to use the Feedback in any manner and for any purpose.
Changes to Terms
We reserve the right to modify these Terms from time to time. If we modify these Terms, we will indicate that we have done so on the Goodfitness www.thegoodfitness.com at or otherwise provide you notice. It is your responsibility to review these Terms regularly. Use of the Service after the effective date of a modification constitutes your acceptance of any modified Terms.
Termination
You may terminate your use of the Service at any time by terminating your account and deleting any Goodfitness App software from your device or personal computer. Termination of your account is your sole right and remedy with respect to any dispute with Goodfitness App regarding the Service or these Terms. Goodfitness App may suspend or terminate your access to the Service at any time, for any reason. If Goodfitness App suspects that you have violated any provision of these
Terms, Goodfitness App may also seek any other available legal remedy. Your rights under these Terms will terminate automatically if you fail to comply with any of these Terms. Upon termination, you must destroy or delete any copy of Goodfitness App software in your possession. You remain solely liable for all obligations related to use of the Service, even after you have stopped using the Service. Neither Goodfitness App nor any of its licensors, suppliers, or publishers are liable to you or to any third party for any loss caused by any termination of the Service or termination of your access to the Service.

We may email or provide you coupons, offers, and other specials from third parties (collectively āPromotionsā). Goodfitness App is not responsible for the redemption, errors, omissions, or expiration of Promotions. All Promotions featured as a part of the Service are subject to change without notice and we have no control over their legality or the ability of any merchant to complete the Promotion (including, the sale in accordance with the offer).
The Service may contain links to Web pages and content of third parties (āThird-Party Contentā) as a service to those interested in this information. Neither Goodfitness App nor its partners will be held accountable for indirect, consequential, or incidental damages, including but not limited to profit loss, data loss, or reputation damage related to service use.
If local regulations donāt allow such liability limitations, the above might not apply to you.
Our maximum liability to you, whether from contract breaches, torts, or other sources, wonāt exceed the larger of the service cost or $10.
The above terms divide risks between us. They are a critical aspect of our agreement.
Every term here is distinct and unaffected by the others. If one doesnāt serve its intended purpose, the rest remain effective.
Indemnity
You will defend, protect and hold Goodfitness App, its affiliates, directors, officers, agents, employees, and its licensors, suppliers, and Distributors harmless from any costs, damages, expenses, and liability caused by your use of the Service, your violation of these Terms, or your violation of any rights of a third party through use of the Service.
Assignment
These Terms, and any rights or licenses granted under these Terms, may not be transferred or assigned by you, but may be assigned by Goodfitness App without restriction. Any assignment attempted in violation of these Terms is void.
Governing Law; Venue
These Terms will be governed by and construed in accordance with the laws of the State of Florida, excluding its conflict of law provisions. You agree that any judicial proceedings will be brought in and you hereby consent to the exclusive jurisdiction and venue in the state and federal courts in Miami, Florida.
Claims
YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, THAT CAUSE OF ACTION IS PERMANENTLY BARRED.
Waiver and Severability of Terms
The failure of Goodfitness App to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Goodfitness App. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the partiesā intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.
Consent to Electronic Communications
By using the Service, you consent to receiving electronic communications from us. These communications may include notices about your account and information concerning or related to the Service. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
You are solely responsible for all fees charged by your telecommunications service provider or any other service provider related to your use of the Service, including without limitation any SMS / text messaging fees, data charges, and other fees.
Entire Agreement
These Terms are the entire agreement between you and Goodfitness App regarding your use of the Service.
